International Software Registering...

Postby David de Argentina » Tue Dec 03, 2013 12:31 pm

Hi all,

I'm just releasing a new software that has some innovative features.

I'm registering this software under Argentina law.

As this software could be useable somewhere in the world, i need know if any could help me in order to register them under US law.

Does any know how to ?

Thanks in advance,

Are you asking for registration of a 'NAME" for a company/product or the product itself.

Trademarking (registering the name) is a rather substantial process. Dave @ Neosoft has dealt with it as he had to control the Neobook name.

I am not aware of a process to register a product. Typically you declare a copyright that does not give people the right to simply take it and sell as their own. If someone tries, your declaration of a copyright in the product itself would be the basis for initiating a law suit for any damages you may have experienced from someone taking your intellectual property.

I suppose you could pursue a Patent for your product but that is a whole other method and you would need to pay to have research done to be sure you were not in violation of someone else's existing patent.

What is your goal here?

Thanks DavidP,

"NAME" is not really important for me.
Supose FaceBook, it could be named "umbrella", the result would have been the same...
everybody would have his umbrella...

I'm thinking in the process to register a product.
The process in Argentina is very similar to you had described in US.

The goal will be if when a clone of my software appears, i would do some reclamations about rights.

Probably what you want to do is register your product with the U.S. Copyright office. Registering a copyright doesn't offer you any special protection from theft. It can be useful in proving ownership of a copyright in a court of law, but the burden of enforcing your copyright is yours alone. The police, government, etc. will not investigate or prosecute copyright infringement.

Hi David,

I don't think another person can register a copyright for you (except maybe a lawyer). I think you can just fill out the appropriate form online at http://www.copyright.gov/forms/ and pay the fee.

Below is some general information about copyrights in Spanish:
